Supreme Court Refuses To Cancel NEET-UG 2024

New Delhi, July 23, 2024 — The Supreme Court on Tuesday refused to cancel the NEET-UG 2024 exam amid allegations of paper leak and malpractice, stating that there was no evidence of a systemic issue compromising the integrity of the entire exam.

A bench comprising Chief Justice of India DY Chandrachud, Justices JB Pardiwala, and Manoj Misra delivered the ruling, emphasizing the severe repercussions a re-examination would have on over 2.3 million students. The court noted that such a move would disrupt the academic calendar and cause cascading effects for years to come.

The court acknowledged the paper leaks at exam centers in Hazaribag, Jharkhand, and Patna, Bihar, but found insufficient evidence to suggest that the leaks had compromised the entire examination process. "The data on record does not indicate a systemic leak of the question paper that would undermine the sanctity of the exam," the court stated.

The petitions to cancel the exam were based on claims of systemic leaks, referencing the precedent set in Tanvi Sarwal v. CBSE (2015). However, the Union government and the National Testing Agency (NTA) argued that the leaks were localized and the beneficiaries identifiable. They presented a data analytics report from IIT-Madras, which showed no significant irregularities in the results or signs of widespread malpractice.

The investigation, led by the Central Bureau of Investigation (CBI), revealed that approximately 155 students from Hazaribag and Patna benefited from the leak. Despite ongoing investigations, the CBI's status reports did not indicate a need to invalidate the entire exam.

The Supreme Court reviewed data from 571 cities and concluded that there was no systemic breach. The bench also considered the adverse effects a re-test would have on the admission schedule, medical education, and the availability of medical professionals. Additionally, it recognized the potential disadvantage to marginalized groups benefiting from reservation policies.

The NEET-UG 2024 exam, held on May 5, saw results declared on June 4. Candidates needed a minimum of 164 out of 720 marks (50th percentile) to qualify for admission.

In summary, the court found no substantial evidence to justify canceling the NEET-UG 2024 exam and emphasized the broader negative impacts such a decision would entail. The investigation continues, but the exam results stand valid for now.
