Edu dept demotes 20 officials who got promotions under quota policy

Taking the first step towards revoking reservations in promotions, the education department on Friday issued a government resolution (GR) stating that 20 officials are being reverted to their earlier positions. Nine of the officials designated as education officers will now be restored as deputy education officers while the rest—deputy directors, project officers and joint secretary assistant commissioners (tribal) —will be demoted by a rank each. Allthe20officialswere given temporary promotions.

The GR comes close on the heels of a Bombay high court order terming reservations in promotions as illegal and unconstitutional. TOI had reported about the state moving the Supreme Court against the HC order, which is set to affect more than 13,000officialswho were promoted based on reservations across government offices and civicbodiessince2004.

“Yes, the decision has been taken following the high court order but the promotions were given on a temporary basis and were subjecttothe ruling. Now, as per thehigh court directives, we are restoring the officials to their earlier posts,” said school education minister Vinod Tawde, adding that henceforth, all promotions will be given in accordancewith merit.

The move has, however, not gone down too well with dalit employees. “The government should wait until the SC’s verdict. Taking action whilethecaseisstillin the apex court isunfair and unjust to employees,” said SC-ST union leader Sanjay Kamble.

RPI leader Avinash Mahatekar said the state should put forth a stronger case before the SC. “While implementing the court order, the government should take care that no dalit employee should feel humiliated. Instead of reverting to the earlier positions, the government should consider shifting them to another equivalent position or section.”

Union minister of state for social justice Ramdas Athavale said he will take up the issue with the PM Narendra Modi. “We have a non-political forum of Parliament’s SC and ST members and we have already demanded that the Centre protect reservations in promotions by formulating a law,” Athavale toldTOI.
